    Draft Moreton Bay Marine parks plan are we screwed?

    Draft Moreton Bay Marine Park Zoning Plan
    Legislation to Restrict Boating in moreton Bay 120 Days per year per person

    Section 107 of the Draft Moreton Bay Marine Park Zoning Plan is set to prohibit boating in the Marine Park zone to no more than 120 days per year per person.

    This legislation does not apply to those navigating and mooring with permission or operating a passenger ferry, but the impact could be felt by recreational boat users, residents of the Bay Islands, live-aboard operations, and commercial operators who could be fined or forced to navigate more red tape.

    Whilst there is support for protecting the bay environment, questions remain about the practicality of enforcing this legislation, who it will be applied to, and whether this will mean more red tape for commercial operators and others enjoying the Bay.

    Section Stew is taking about is on page 75.
    Sounds like the old trick of including something controversial that everyone will complain about and slip in the things that they really wish to do unnoticed.

    There'll be some serious trailor traffic heading north and south for those other 8 idle months if this crap eventuates.

    So here is the part that this 120 days relates to. I'm guessing it means 'continuous' movement, but hey, what do I know. (aircraft??)

    Division 2 Other restrictions

    107 Prohibition on navigating for more than 120 days

    (1) A person must not navigate a vessel or aircraft in the marine

    park for more than 120 days in any 1 year.

    Maximum penalty—10 penalty units.

    (2) Subsection (1) does not apply to a person—

    (a) navigating with a permission; or

    (b) mooring in compliance with section 56; or

    (c) navigating a vessel, ferry or water taxi service for the

    transfer of passengers or vehicles.

    Just did some more digging.
    This clause already exists in the 2008 management plan.
    No changes.

    This is what happens when everyone starts complaining we all get what we never thought we would ever get.

    May be its time to only pay for the days we put our boats on the water if there going to go down this silly road what do we pay boat rego for 120days a year not 365 days a year to go boating and fish.

    I think you'll find this clause is aimed at preventing extended lay-overs and permanent or semi-permanent live aboard vessels cluttering up the bay. That's why people have to use marinas and recognised moorings. It would be political suicide to try and apply this to recreational use.
    Even tho it could certainly use some clarification, it'll take a smart wordsmith to do this without creating loopholes to be exploited.
