Thread: Check your gear or you could net a fine

    Re: Check your gear or you could net a fine

    Have you guys ever seen some shamateurs and what damage they can do to a waterway with their illegal gear? I bet you blokes calling foul on fisheries raiding his house and taking it all + fining him would be calling fouler if he rocked up to your local fishin hole and sat there eyeing it off with his sh!tbox ute overflowing with ex-pro stuff....
    Anyway, it doesn't take a genius to work out there would be more to the story than old matey fisheries officer strolled in to your neighbours yard 'cause he didn't like the look of him and felt like nicking him for something. Read between the lines, otherwise read the realandy's post if the lines are too blurry for you.

    Fisheries cant win, if they dont do something they get slammed, if they do they get slammed...and no one knows all the facts, they made a press release designed to warn people with an example of what can happen.... no law is perfect but the fact they are doing something is a tick...if they are wrong then it will be sorted out in court

    Re: Check your gear or you could net a fine

    So what about my cast net that I've got in the shed for trips I take into QLD? Might as well come fine me. My parents live on the water and when I lived at home the cast net was in the shed not 40m from the water. What about that?
    What about the house I helped a mate move into which was previously owned by an ex-mullet mesher? That had more commercial gear left there than most blokes see in a lifetime! He didn't even know what it was until we cleared it out. What if fisheries decided to do a raid while we were moving him in and we hadn't the time to clear the shed out? Just a casual few grand in fines? No biggy huh?
    Just because it's law, doesn't mean it's appropriate nor correct.

    And please Kock, before you present any more of your (unsubstantiated) claims, can you please use the spell check function and render your rant as legible and correct. Maybe a full stop, a capital letter and a comma could be added for good effect to. I know this site isn't school, but it's also not up to anyone else to pretend they're in first grade again to attempt to read what you're putting across.

    Mattooty, lets say your mate was dobbed in by someone who saw the nets and the fisho's came around. Your mate would've been able to explain why they were there and declared his innocence.

    The crucial question should be, would the officers still fine him or let him be? In Vic they would let him be while explaining the law. The fisho's here are good people doing a difficult job for very little money compared to police.

    I've never seen evidence on here that it would be any different in NSW or QLD.

    Your mate even if fined would still be able to fight it in court which is another reason for the fisheries officers to let it go.

    Mattooty- If you want to give spelling lessons & diction direction, particularly in a public arena, make sure you are infallible. Lesson I was taught early by my old man- you stick your head up, someone is going to want to take a shot at it.
    You have made a spelling mistake that stands out like dogs balls. No need to tell you what it is, as an educated man, such as yourself, once you have reread your post, will pick it up in a heartbeat

    Tony, if you could kindly point it out that would be fantastic as, as far as I'm aware, there aren't errors within the post. I'm not putting my head up as an educated idiot. I'd just enjoy being able to read a legible reply. A mistake with typing, a missed comma or forgetting a capital once in a while doesn't phase me, however entire slabs of replies consisting of sentences requiring the reader to use hieroglyphs, a dictionary and 2 different pairs of glasses don't stand well in a well structured argument. Mind you, my fat fingers don't help when I'm trying to post from a smart phone (lesson learnt, never again!)

    Back on topic, after reading through the original post again and discussing this case with a mate, I've swung to firmly support the fisheries officers in their decisions. The under-funded buggers are damned if they do and damned if they don't it seems. I can only imagine the stink being kicked up if they didn't take action upon seeing the net hanging from the car in question.

    mattooty- I'm just a bored fisherman spending too much time on Ausfish!! The error mate was in the use of the word "to" when it should have been "too", meaning also in this context.
    You are right though, I got a headache reading kock81"s posts. He's probably a really nice bloke, albeit a dumb arse fisherman, who can lift heavy things but aint too sharp.
    You have got to admire his passion though, & the fact that what he said is correct, even if written in Egyptian!!

    There is also a comma missing after "biggy," but what sort of depraved, deprived, deplorable, deprecating pedant would notice such a thing?!!

    Well done FQ. I am pretty certain the bloke wasn't driving around with the net in the back for decorative purposes.Pity the fine wasn't bigger but- 20k would soon sort these sorts of blokes out.

    The in possession limit also refers to fish kept at home in the freezer. The fisheries need to have access to implement the law if there is sufficient evidence to suggest there may be a breach - something I have no doubt is looked at closely when such cases go to court. If there is not reasonable cause to inspect I dare say the case would be thrown out so FQ would make sure they are in the right. Anyway lets face it, it would only get to court if they are found to be in breach.
    Property inspection has been used a number of times in recent years with certain grey nomads staying months in caravan parks up this way and loading up on 100s of whiting and flathead fillets. These people are dobbed in, their premisses searched and they get done for it. Anyone have a problem with that?

    Charlie I doubt very much that the Fisheries inspectors just got lucky during their rein of random house checks. They had some very clear evidence and enough to warrant an inspection which lo and behold resulted in a number of other illegal nets. Would you still hold his residential sovereignty as sacrosanct if he was caught with kiddie porn instead of nets? I doubt it.
    If legislation is there then there needs to be mechanisms in place to allow it to be enforced. Sure corruption will always happen but I doubt they waste their time pinging a few grubs for illegal nets for shits and giggles. In any case potential corruption of a minor scale is no reason to limit authorities ability to enforce the law.

    I think the law says something about running a net from bank to bank.

    Fisheries lost me that time they sat up on a hill above a "Green Zone" and mailed fines to the registered addresses of the dinghies and mother ship fishing there instead going down there and actually stopping them from raping a protected fishery and making them put back what they caught.

    Then they swoop on a guy with all the vengeance of a Valkyrie because he has 4 nets.

    Do it properly fellas.

    yeah it does say something:

    198 Particular fishing methods prohibited
    (1)A person must not take fish in any of the following ways—
    (a)by jagging or foul-hooking;
    (b)using underwater breathing apparatus, other than a snorkel;
    (c)using a crab hook;

    (d)using fishing apparatus across a waterway or navigation channel in a way that makes more than half of its width impassable to a boat or fish.

    and who hasn't at least been guilty of jagging or foul hooking - or both at once lol?
