Labor Senator Jan McLucas has today moved in the Senate that the Minister for Environment and Heritage produce documents relating to De-Anne Kelly’s behind the scenes intervention in the zoning of the Great Barrier Reef Representative Areas Program.

Called a ‘Return to Order’, Senator McLucas’ motion exercises the Senate’s powers to require ministers to place documents or information on the public record. Senator McLucas’ Return to Order follows attempts on the part of Sunfish Mackay to obtain this documentation from GBRMPA.

“The Return to Order follows strong representations from Sunfish Mackay and Whitsunday, the Whitsunday Chamber of Commerce and the overwhelming majority of the community opposed to unexpected, eleventh hour changes made to RAP boundaries,” Senator McLucas says. “The government is now required by the senate to table this material by Wednesday at 3.00 pm.”

‘A third party’ has to date refused to agree to allow GBRMPA to release these documents under Sunfish’s FOI request. GBRMPA wrote again on 4 August to Sunfish Mackay to indicate the documents may be made available in sixty days in the absence of any objection from third parties, who I presume to mean Mrs Kelly, to the Administrative Appeals Tribunal.

Senator McLucas explains that her Return to Order motion is designed to ensure the documents are available before the federal election is called.

“If Mrs Kelly and the Howard Government have nothing to hide, these documents, which would have already been identified for the FOI process, will be tabled in the Senate as requested on Wednesday afternoon,” Senator McLucas points out.

So as has always been the case what's GBRMPA trying to hide ;D. Really doesn't do them any favours but in the long run the truth will come out and some obviously aren't going to be comfortable with that, for a number of reasons.

If you listened to the debate the Minister was a joke.

There had been a motion passed 4 pm Tuesday that the Minister table the documents by 3pm yesterday.

So when he failed to do so he says that there are too many documents and there were 3000 submissions # etc etc

Then in response Senator Jan McLucas says that the documents are already “ found” #and sitting on the desk of the FOI officer in Townsville. # Which clearly they were, given the Sunfish FOI application.

This is a disgusting abuse of Democracy. # #An outright lie.

Go call a few Senators now.

I'm just reading the document now. The truth will come out eventually but will there be any hope of (or time for) changes based upon it? It seems to me that the government is more interested in making it watertight in case of a legal challenge. I guess if there is a legal challenge to the zoning process this then becomes evidence of some sort of deception/underhandedness which may be then used to reverse not only the changes in Repulse Bay but also for any other challenge to the zoning. Is this possible, are there other areas?

Hi all,

Repulse Bay is the only one we KNOW of but there may certainly be more. We know this because we saw the first draft zoning plan which had Repulse Bay a yellow zone. Our community was prepared to accept (begrudgingly) the overall RAP plan IF as a trade-off to the green zones, we got the nets and more importantly beam trawlers out of Repulse Bay.

The second raft zoning plan had removed the yellow zone and turned it back to a blue zone and a group of us, including the chair of our LMAC were told by senior GBRMPA staff that this change was as a direct result of ministerial (Kemp) intervention. Kemp was lobbied by De-Anne Kelly including a letter (which we have) which says in part..."while the concerns of recreational fishers have been properly taken into account'only 3% of local people fish recreationally.

If it is only 3% why is she so worried. She holds the seat by about 8%.

It is alo interesting that Senator Campbell believes that yellow zones are recreational only. Does not even understand his own zoning rules.....is this misleading parliment??

The Fishing Party (Qld) is right in the middle of this supporting Sunfish Mackays FOI application and providing information to Senator McLucas.

If De-Anne Kelly & Kemp had kept their noses out of RAP The Fishing Party (Qld) would not even have started (& I would still have time to go bloody fishing once in a while..)

This whole issue should get interesting over the next few days.

Well Kemp has done his dirty deeds, been rewarded and is now leaving the scene. Is Kelly about to do the same?
Heard on talkback radio a rumour that the green zones are a SECRET trade off for the passing of the GST. Deal done between Scumbag howard and Traitor meg lees.

It's not even a secret. Howard adopted the Democrats "Oceans Policy" (all about closures) in exchange for Meg Lees support to pass the GST in the senate. This whole thing is all about politics and was never about science.

GBRMPA visited our area last week to explain the new zones and 12 locals showed up over the 4 hours allocated. A very poor response we thought and in fact, about all it deserved. However, the GBRMPA rep commented on the good turn out!

Seems the whole process is being treated with contempt by Joe Public.

wonder who will get shafted when the govt sell the rest of telstra. north qld got it for the gst. it will need support through the senate- maybe fraser or a bit further south would keep the greens happy. time to speak up.

As we read above, politics is all about deals.

This is my ocncern about the Fishing Party's policy of supporting the Government of the day on most issues.

It (sadly) seems to me that if the Fishing Party is to be effecive, it needs to get in there, boots and all, and play deals like the best of them.

No need for an answer kc. Best not. Maybe over a coffee one day

No need to wait for a coffee gary, you missed the very point about supporting the Government of the day.....we very carefully say "In Principle" in terms of this...we understand the grubby game of politics and backroom deals and will be in their swinging if we are in any position to offer "in principle support. We might be beginners at this but we are learning fast.
