Hi guys

Can anyone help me with the results of NCC court hearing with the AAT regarding the grey nurse exclusion zones. Its not getting much publicity and that frightens me.

After a week of hearing about the dire plight of the Grey Nurse Shark, the legal appeal aimed at winning increased protection for these magnificent creatures was adjourned this afternoon.

Due to the wealth information that has been presented to the Administrative Appeals Tribunal this week, it has been necessary for the hearing to continue. Originally expected to be finalised today, the Nature Conservation Council’s appeal against the Federal Minister for the Environment’s approval of the Ocean Trap and Line Fishery will have further hearings in the coming months.

Justice Downes said at the hearing today “this is an incredibly important case”. Justice Downes observed the need to fully consider the requirements of the Environmental Protection and Biodiversity Conservation Act and clearly identify the activities that are detrimental to the survival of the Grey Nurse Shark.

“This week’s discussions have highlighted the threat that commercial and recreational fishing poses to the very survival of the Grey Nurse Shark,” Ms Cate Faehrmann, Director of the Nature Conservation Council said today.

“We have heard detailed descriptions of each of the Grey Nurse Shark key habitat area in NSW and Commonwealth waters and the important role these areas can play in protecting the sharks.

“We look forward to future opportunities to highlight the way simple fishing gear changes could also increase protection for the sharks,” Ms Faehrmann said.

A date for future hearings will be set next week but it is not expected to be very several weeks.

Steeling myself for a scary outcome!! sad actually, how can the Gov possibly put a case forward without shooting it's self in the foot over the original justifications used to make the lockout zones.

One trusts the court can see the transperancy of both sides of this court case, but
I doubt in real life that such an insular institution would care one way or another the outcome or it's real effects, it's a shame evidence and proof today are so far apart in real terms that proof will not be expected and evidence will continue to be fabricated for courtrooms.
